Every framework in this body of work was developed in active litigation before it was formalised in print. The practice is what separates the work from commentary: instruments built by an advocate who takes instructions from clients, frames matters across jurisdictions, argues before benches, drafts under deadline, and lives with the consequences of the advice he gives.
Shivam Shukla has practised before the Allahabad High Court since 2019 and independently since 2022 from Chamber No. 40. The work spans original writ jurisdiction, special appeals, second appeals, criminal quashing and bail, civil and revenue appeals, supervisory jurisdiction, habeas corpus, tax writs, and public interest litigation, before Single Judge benches, Division Benches, and the Chief Justice's bench.
He works with solicitors, legal advisors, and co-counsel across jurisdictions. Consultations on legal strategy, case assessment, and appellate planning form a regular part of the practice alongside courtroom advocacy. From July 2023 to June 2026 he was a co-founder of Bharat Litigation Law (with Aniket Gupta, LL.M., NLU Jodhpur), serving as its legal & regulatory advisory consultant on matters for clients in banking, payments, e-commerce, and insurance; the engagement was advisory, not counsel on record, and concluded in June 2026. Constitutional & Writ Jurisdiction
Judicial review of State action, administrative decisions, and regulatory authority orders. Writ petitions under Article 226, supervisory jurisdiction under Article 227, special appeals, service and disciplinary matters, tax writs, and public interest litigation. The core of the practice.
Civil, Revenue & Appellate Practice
Property, injunction, and title disputes; revenue matters including land, mutation, consolidation, and patta; first and second appeals; challenges to orders of revenue authorities; cooperative and insurance disputes.
Criminal & Criminal Writ Practice
Defence and challenge jurisdiction across pre-trial, appellate, and revisional stages. Quashing of FIRs, bail and anticipatory bail, criminal appeals and revisions, habeas corpus, and special legislation.
Family & Matrimonial Law
Matrimonial disputes and divorce, guardianship and custody, maintenance and succession, domestic violence proceedings, and family court appeals with Article 227 supervision.
How the practice operates.
- Legal strategy and case assessment. Structured analysis of the legal position before a matter is filed: the strongest ground, the correct forum, the right sequence, and the arguments to withhold.
- Cross-forum litigation. Co-ordinated proceedings across multiple forums: writ jurisdiction alongside criminal proceedings, revenue appeals parallel to civil suits, appellate strategy across every level.
- Appellate and revisional practice. Identifying the legal question that survives the facts and framing it for a bench that has not heard the evidence.
- Consultation for solicitors and legal advisors. Opinions on legal position, litigation risk, and appellate planning for instructing counsel who need High Court perspective.
- Sustained multi-stage litigation. Matters running across years: escalation from representation to writ to contempt to compliance, with strategic sequencing across hearings and benches.
- Institutional advisory (2023–2026). Legal and regulatory analysis, risk assessment, legal opinions, and responses to statutory and regulatory notices for clients in banking, payments, e-commerce, and insurance, through the Bharat Litigation Law advisory engagement, concluded June 2026.
